1.  Introduction

These Terms constitute a legal agreement between you and Legion of Rowers Incorporated (referred to as "the Society", "we", "us", or "our"), an Incorporated Society registered in New Zealand.  Membership is determined by the Legion Of Rowers' Constitution.

2. Membership

2.1 Eligibility and Registration

To become a member of the Legion of Rowers, you must complete the online registration form and pay the applicable membership fee. By registering, you warrant that:

• You are at least 18 years of age (or have the consent of a parent/guardian).

• All information provided is accurate, current, and complete.

• You agree to abide by the Constitution and Rules of the Society.

2.2 Membership Fees

• All membership fees are displayed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless otherwise stated.

• Membership fees are payable annually (or as otherwise specified on the membership page).

• We reserve the right to change membership fees at any time; however, fee changes will not affect current memberships until their renewal date.

2.3 Membership Cancellation and Refunds

• Voluntary Cancellation: You may cancel your membership at any time by contacting us. However, membership fees are non-refundable unless required by the Consumer Guarantees Act 1993.

• Termination by Society: We reserve the right to terminate or suspend your membership if you breach these Terms or the Rules of the Society.

3. Donations

3.1 Voluntary Nature

Donations made to the Legion of Rowers are voluntary and are used to support the objects and cause of the Society.

3.2 Tax Receipts

The Legion of Rowers is not a registered charity, although it does have charitable purposes.  As such, we are unable to issue tax credit receipts for any donations made.

3.3 Refund of Donations

Donations are generally non-refundable. However, if you believe that an error has been made in connection with your online donation (e.g., a technical error resulting in a duplicate deduction), please contact us immediately. Refunds for donations are granted at the sole discretion of the Society or as required by law.

4. Payments

4.1 Payment Processing

We use third-party payment gateways (e.g., Stripe & Polipay) to process payments. We do not store your credit card details on our servers. By making a payment, you agree to be bound by the terms and conditions of the selected payment processor.

4.2 Security

While we take reasonable steps to ensure the security of online transactions, we cannot guarantee the absolute security of any data transmitted over the internet.

5. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Legion of Rowers Incorporated or its content suppliers and is protected by New Zealand and international copyright laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

6. User Conduct

When using this website, you agree not to:

• Use the website for any unlawful purpose.

• Attempt to gain unauthorized access to any part of the website or member accounts.

• Harass, abuse, or harm other members or users.

• Transmit any viruses, malware, or harmful code.

7. Limitation of Liability

7.1 Consumer Guarantees Act

Nothing in these Terms is intended to limit or exclude any rights you have under the Consumer Guarantees Act 1993 (CGA). If you are acquiring goods or services from us for personal, domestic, or household use, you have certain rights and remedies under the CGA that cannot be excluded.

7.2 General Limitation

Subject to clause 7.1 and to the extent permitted by law:

• The Legion of Rowers excludes all liability for any indirect, incidental, special, or consequential damages arising out of your use of the website or your membership.

• Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you (if any) for membership in the preceding 12 months.

8. Privacy

Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy, which complies with the Privacy Act 2020. By using our website, you consent to the collection and use of your information as outlined in that policy.

9. Events and Activities

Participation in rowing events or physical activities organized by the Society carries inherent risks. By participating, members acknowledge these risks and agree that they participate at their own risk. The Society accepts no responsibility for any injury, loss, or damage sustained during such activities, except where such liability cannot be excluded by law (e.g., under the Health and Safety at Work Act 2015).

10. Amendments

We reserve the right to amend these Terms at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the website or renewal of membership following any changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
